terms
Last updated 4th November 2026. These terms are in two parts. Part A covers anyone using this website. Part B also applies if you subscribe to a pivotworks bundle.
In these terms, "pivotworks", "we" and "us" means Giles C Stead trading as pivotworks, ABN 64 669 170 570, Brisbane, Queensland. "You" means the person or business using this website or subscribing.
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law, or any other law, that can't lawfully be excluded, restricted or changed.
Part A: using this website
A1. Information on this site. We work to keep this site accurate and up to date, but it may contain errors or go out of date. Blog posts and help articles are general information only. They aren't accounting, tax or legal advice for your circumstances.
A2. Our content. The text, images, manuals and other material on this site belong to pivotworks or are used with permission. You're welcome to read, print and share pages for your own business use, as long as you keep our name on them. Please don't republish or sell our material without asking.
A3. Other websites. We link to other websites, such as Stripe for payments. We don't control those sites and aren't responsible for their content or how they handle your information.
A4. Using the site properly. Please don't try to break into, overload, copy in bulk or interfere with this site, or use it for anything unlawful.
A5. Trademarks. Oracle and NetSuite are registered trademarks of Oracle and/or its affiliates. pivotworks is an independent business and is not affiliated with, or endorsed by, Oracle.
A6. Liability for the website. We provide this website free of charge. To the extent the law allows, we aren't liable for any loss that comes from using it or relying on it.
Part B: subscription terms
B1. Agreeing to these terms. By subscribing, you agree to Parts A and B, our Refunds and cancellations page, and our Privacy policy. If you subscribe on behalf of a business, you confirm you're authorised to do so.
B2. What you get. While your subscription is active and paid, you get:
a non-exclusive, non-transferable licence to install and use the bundle in one NetSuite account (the account ID you give us at checkout), for your own business purposes
any updates we release for the bundle
the user manual, and support through our Help page during Queensland business hours.
B3. Getting started. We'll make the bundle available to your NetSuite account, usually within 1 to 2 business days of your first payment, and email you when it's ready. If we can't make it available within 10 business days, we'll refund your first payment in full.
B4. What you can't do. You must not:
copy, modify, decompile or reverse engineer the bundle, or try to extract its code, except as the law allows
share, resell or sublicense the bundle, or install it in another NetSuite account
use the bundle for anything unlawful, including sending emails that breach the Spam Act 2003 (Cth).
B5. Your settings and your emails.
The bundle runs inside your NetSuite account and does what your settings tell it to: sending emails, creating records and applying credits. You choose those settings, schedules, templates and recipients.
Please check your settings, using the user manual, before you switch the bundle on.
You're responsible for the content of the emails sent, and for having the right to contact the people they go to.
B6. NetSuite. You need your own active NetSuite account. NetSuite is supplied by Oracle, not by us. We aren't responsible for NetSuite's availability, or for changes Oracle makes to it, but we'll work to keep our bundles compatible with current NetSuite releases.
B7. Price and payment.
The price is the monthly price shown on our website when you subscribe (we are not registered for GST, so no GST is charged).
You pay monthly in advance, by card, through our payment provider Stripe. Your first payment is taken when you subscribe, then on the same date each month. We email an invoice for each payment.
We never see or store your full card details.
If a payment fails, Stripe will retry it and email you. If it still can't be collected, your subscription will end and B9 applies.
B8. Price changes. We'll email you at least 30 days before a price change takes effect. If you don't want to pay the new price, you can cancel before then at no cost.
B9. Cancelling and what happens next.
You can cancel at any time through Manage subscription on our website, or by emailing us. There's no minimum term and no cancellation fee.
Cancellation takes effect at the end of the month you've paid for, and you won't be charged again.
When your subscription ends, your licence ends. You must uninstall the bundle from your NetSuite account within 14 days.
Uninstalling may remove the fields and logs the bundle added to NetSuite, along with anything stored in them, so export anything you need first. Your other NetSuite data isn't affected.
B10. When we can end or suspend a subscription.
We may suspend or end your subscription if you seriously breach these terms and don't fix the breach within 14 days of our email asking you to. We can act straight away if the breach can't be fixed, such as sharing the bundle with another account.
We may stop offering a bundle. If we do, we'll give you at least 60 days' notice and refund any amount you've paid for time after it stops.
B11. Access to your NetSuite account. If you give us access to your NetSuite account to install or support a bundle, we'll use it only for that job, keep anything we see confidential, and end the access when the job is done.
B12. Consumer guarantees.
Our bundles come with guarantees that cannot be excluded under the Australian Consumer Law.
Our bundles aren't of a kind ordinarily bought for personal, domestic or household use. So, to the extent the law allows, if a bundle or our support fails to meet a consumer guarantee, our liability is limited to one of the following, at our choice:
fixing or replacing the bundle
supplying the support again
paying the cost of doing either.
B12.2 doesn't apply where it wouldn't be fair or reasonable for us to rely on it.
B13. Limits on liability. Subject to B12, and to the extent the law allows:
We test our bundles carefully, but every NetSuite account is set up differently. We don't promise a bundle will be free of errors or work without interruption.
Neither of us is liable to the other for indirect or consequential loss, including loss of profit, revenue or data.
Our total liability to you under these terms is limited to the amount you paid us in the 12 months before the claim arose.
We aren't liable for loss to the extent it was caused by your settings or email content, by NetSuite, or by not following the user manual.
B14. Our property and your ideas. We own the bundles, the manuals and our website. If you send us suggestions, we may use them to improve our products, without any obligation to you.
B15. Changes to these terms. We may update these terms, for example when the law changes or we add features. We'll email you at least 30 days before any change that's materially worse for you. If you don't agree, you can cancel before the change takes effect. Other changes take effect when we post them here.
B16. Events outside anyone's control. Neither of us is responsible for delays or failures caused by events beyond our reasonable control, other than a failure to pay.
B17. General.
We'll send notices to the email address in your subscription. You can send notices to grow@pivotworks.au.
These terms are governed by the law of Queensland, and the courts of Queensland have jurisdiction.
If any part of these terms can't be enforced, the rest still applies.
